GENERAL TERMS OF USE AND SALE

1. Purpose and general provisions

These General Terms of Use and Sale (hereinafter, the "Terms") regulate the access, browsing, and purchase of products through the website salazonarte.com (hereinafter, the "Website"), owned by Alejandro Navarro Sánchez, with tax identification number (NIF) 18440335Q, registered office at Av. Vía Láctea, 20, 28938 Móstoles (Madrid) and commercial establishment in the Central Market of Valencia (hereinafter, "SalazonArte"). Contact: info@salazonarte.com.

Access to the Website and placing any order imply full and unreserved acceptance of the version of these Terms published at the time of purchase. If you do not agree with them, you should refrain from using the Website and placing orders.

The Website is intended exclusively for individuals over 18 years of age with legal capacity to contract, who purchase products as final consumers. The resale of products purchased through the Website without prior written authorization from SalazonArte is expressly prohibited.

The sales and delivery territory is the Iberian Peninsula (peninsular Spain) (hereinafter, the "Territory"). SalazonArte does not ship abroad or, at present, to the Balearic Islands, Canary Islands, Ceuta, and Melilla. SalazonArte reserves the right to reject or cancel orders with delivery addresses outside the Territory, or that are incomplete or inaccurate.

Right to refuse orders. SalazonArte reserves the right to reject or cancel any order when there are reasonable indications of fraud, non-payment, misuse of the Website, abuse of promotions, orders for unauthorized resale, or breach of these Terms, notifying the Customer and, where applicable, refunding the amounts paid. The refund of said amounts will constitute SalazonArte's sole obligation in these cases, without any additional compensation being due.

2. Product Information

The descriptions, photographs, videos, weights, and other product information published on the Website are for guidance only. As these are artisan and natural products, there may be reasonable variations in appearance, color, size, piece size, or drained weight compared to the images shown, without this constituting non-conformity.

Fresh and perishable products. Almost all of SalazonArte's catalog (olives, pickles, salted products, sliced preserves, gildas, and artisan preparations) are perishable or quickly expiring food products that require adequate storage conditions. The Customer is obliged to follow the storage instructions for each product from the moment of receipt. SalazonArte is not responsible for deterioration resulting from inadequate storage after delivery.

3. Prices, availability, and errors on the Website

All prices are shown in euros and include applicable VAT. They do not include shipping costs, which are calculated and communicated to the Customer before finalizing the purchase and must be expressly accepted by the Customer.

Errors in price, quantity, description, or stock. Despite SalazonArte's effort to keep information updated, the Website may contain typographical errors, errors in price, quantity, weight, description, image, or availability, whether human or computer-generated. The publication of a manifestly erroneous price or data does not bind SalazonArte or oblige it to sell the product under those conditions. If an error is detected after an order has been placed, SalazonArte will inform the Customer as soon as possible and the Customer may choose between: (i) having SalazonArte offer to maintain the order at the correct price or conditions, or (ii) totally or partially canceling the order with a full refund of the amounts paid for the canceled part. The refund of such amounts will constitute SalazonArte's sole obligation in these cases, without any additional compensation being due.

SalazonArte reserves the right to modify prices, products, promotions, and commercial conditions of the Website at any time, without affecting orders already confirmed, except as provided in the preceding paragraph.

In case of unforeseen unavailability of a product after an order has been placed, SalazonArte will inform the Customer by email and will proceed to a total or partial cancellation of the order with a refund of the corresponding amount, without any additional compensation being due.

4. Payment and security

The Customer is obliged to pay for the order at the time of its placement using one of the payment methods enabled on the Website. Applicable shipping costs, communicated before formalizing the purchase, will be added to the price of the products.

Payments are processed through secure third-party payment gateways with SSL encryption. SalazonArte does not access or store complete credit card details or other payment methods. The Customer must notify SalazonArte of any undue or fraudulent charges as soon as possible so that appropriate action can be taken.

SalazonArte may suspend or cancel any order when payment is rejected, reversed, or shows signs of fraud, without prejudice to claiming any damages and expenses caused by such circumstances.

5. Order Formalization

Once the purchase process is completed, the Customer will receive a confirmation email with the order details. This email confirms receipt of the order; the contract will be considered perfected upon SalazonArte's confirmation of order dispatch.

The Customer is responsible for the accuracy of the data provided (address, contact phone number, email). SalazonArte will not be responsible for incidents, delays, or failed deliveries resulting from erroneous, incomplete, or outdated data provided by the Customer, and associated costs (reshipment, return, management) will be borne by the Customer.

6. Order Cancellation by the Customer

The Customer may request to cancel their order free of charge, provided the request is received before the order is prepared and dispatched, and it is not a special order or for products prepared to order or by request.

If the order has already been prepared or dispatched, the cancellation will be treated as a return according to clause 9, and the Customer will bear the costs of preparation, outward and return transport, as well as associated management fees, which may be deducted from the amount to be refunded.

7. Shipping, delivery times and receipt

Estimated delivery times. SalazonArte usually dispatches orders within 24 to 72 business hours, with a typical delivery time of 1 to 3 business days from dispatch and, in any case, within the legal maximum period of 30 calendar days. The times indicated on the Website are average estimates and do not constitute an essential commitment of the contract.

Shipping delays. Delays attributable to the transport company, logistical or climatic reasons, or force majeure will not constitute a breach by SalazonArte, will not entitle the Customer to reject delivery of the order or to terminate the contract, unless the maximum legal delivery period is exceeded or mandatory consumer regulations dictate otherwise. If the Customer unjustifiably rejects receipt of an order due to a mere shipping delay, they will bear the costs of shipping, return to origin, and management, as well as the value of any perishable goods that are damaged or unusable as a result of the rejection; these amounts may be deducted from any refund.

Delivery will be considered complete when the transport company makes the product available to the Customer at the indicated address, according to the carrier's tracking system. From that moment, the risk of product deterioration—especially relevant for refrigerated or perishable products—is transferred to the Customer.

Recipient not present. If the Customer is absent at the time of delivery, they must arrange a new delivery with the carrier as soon as possible. In the case of perishable products, the Customer assumes the risk of deterioration resulting from the impossibility of delivery due to reasons attributable to them. If 10 business days pass from the first delivery attempt without delivery being possible due to a reason attributable to the Customer, the order will be returned to origin, and the Customer will bear the costs of shipping, return, and management, in addition to the value of any perishable goods that become unusable.

Diligence upon receipt. The Customer must check the condition of the package in the presence of the carrier and note any visible anomalies (dents, breakages, moisture, signs of opening) on the delivery note. Any incident detected after opening the package must be reported to info@salazonarte.com within a maximum of 24 hours from delivery, attaching photographs of the packaging and the damaged product where the damage is clearly visible. The absence of reservations on the delivery note and timely communication with the indicated photographic support may prevent the incident from being processed with the carrier.

8. Right of withdrawal and its exceptions

In accordance with Royal Legislative Decree 1/2007 (TRLGDCU), the consumer generally has a period of 14 calendar days from receipt to withdraw from the contract without needing to provide justification.

Legal exceptions applicable to the SalazonArte catalog (Art. 103 TRLGDCU). The right of withdrawal will NOT be applicable to:

     Goods that may deteriorate or expire quickly (fresh and perishable products: cut olives and pickles, sliced cured fish, gildas, banderillas, and other artisanal preparations, and in general all products requiring refrigeration).

     Sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery (opened jars, cans, vacuum-sealed containers, or heat-sealed bags).

     Goods manufactured according to the Customer's specifications or clearly personalized (custom cuts, batches, or preparations).

Since almost all SalazonArte products fall under one of these exceptions, the right of withdrawal will be limited, in practice, to non-perishable products that are returned unopened, with their original seal and packaging intact, and in perfect condition for preservation and resale.

When withdrawal is applicable, the Customer must notify info@salazonarte.com within the deadline, will bear the direct costs of return, and will be responsible for any decrease in the value of the goods resulting from handling other than what is necessary to establish their nature and characteristics. SalazonArte may withhold the refund until the goods have been received and their condition verified.

9. Returns: prior authorization and deductions

All returns require SalazonArte's prior and express acceptance. Before making any return, the Customer must contact SalazonArte via info@salazonarte.com within the applicable deadlines, stating the reason and, if applicable, providing photographs. SalazonArte will inform the Customer if the return is accepted and the procedure to follow (return address, packaging, carrier). No return made without this prior authorization will be received or processed, and its costs and risks will be entirely borne by the Customer.

Deductions. Once the condition of the returned merchandise has been verified, SalazonArte reserves the right to deduct from the amount to be refunded, in a justified manner and depending on what happened, the corresponding expenses and depreciations, including, among others: outward and return transportation costs, preparation and management costs, and the decrease in the value of the products due to handling, opening, deterioration, lack of original packaging, or impossibility of resale. In the case of perishable products returned without a cause attributable to SalazonArte, the depreciation may reach 100% of their value. In the case of consumers who validly exercise their right of withdrawal, these deductions will only be applied within the terms permitted by consumer regulations.

The refund, once the merchandise has been checked and the applicable deductions determined, will be made by the same payment method used in the purchase, unless otherwise agreed with the Customer.

Defective or spoiled products. If the product arrives in poor condition or has a lack of conformity not attributable to transport or preservation after delivery, SalazonArte, after verification (which may require photographs or the return of the product for examination), will proceed to replace it or issue a refund, assuming the corresponding costs in such a case. It is essential to communicate these incidents as soon as possible and, in the case of perishables, within 24 hours of delivery.

10. Product warranty and conformity

SalazonArte guarantees that the products are dispatched in perfect condition, within their useful life, and in conformity with their description. Responsibility for lack of conformity will be governed by current regulations, taking into account the perishable nature of the products and their expiration or best-before date, which defines the period during which such conformity can be demanded. Any claim must be communicated to info@salazonarte.com, providing the order number and supporting documentation.

11. Intellectual and industrial property

All content on the Website (texts, product sheets, photographs, videos, logos, trademarks —including SalazonArte and OlivArte—, designs, source code, and databases) are the property of Alejandro Navarro Sánchez or third parties who have authorized their use, and are protected by Spanish and international intellectual and industrial property legislation. Total or partial reproduction, distribution, public communication, transformation, or any other form of exploitation, including through hyperlinks or scraping or automated data extraction techniques, is prohibited without prior written authorization from SalazonArte.

12. Responsibility and use of the Website

The Customer and User are responsible for their use of the Website and its content. SalazonArte does not guarantee the uninterrupted availability of the Website or the absence of errors in its content, and will not be liable for damages derived from causes beyond its reasonable control, such as network failures, cyberattacks, fortuitous events or force majeure, nor for the content of linked third-party sites.

Limitation of liability. To the extent permitted by law and without prejudice to the inalienable rights of consumers, SalazonArte's total liability to the Customer for any incident arising from an order will be limited to the amount effectively paid for that order, and SalazonArte will not be liable for indirect damages or lost profits.

Force majeure. SalazonArte will not be liable for non-compliance or delay in fulfilling its obligations when due to force majeure or events beyond its reasonable control, including, but not limited to: strikes, transport incidents, extreme weather events, supply cuts, health incidents, or decisions by authorities.

13. Personal data protection

The processing of personal data of Customers and Users is governed by Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), under the terms detailed in the Website's Privacy Policy and Cookies Policy, which form an integral part of these Conditions. The data will be processed for order management, commercial relations, and, with the data subject's consent, for sending commercial communications. The data subject can exercise their rights of access, rectification, erasure, opposition, restriction, and portability by contacting info@salazonarte.com.

14. Partial nullity and non-waiver

If any clause of these Conditions is declared null or unenforceable, the remaining clauses will retain their validity and will be interpreted in accordance with the will of the parties and the purpose of these Conditions. SalazonArte's failure to exercise any right recognized in this document will not imply a waiver thereof, unless expressly acknowledged in writing.

15. Modification of the Conditions

SalazonArte reserves the right to modify the presentation and configuration of the Website and these Conditions at any time. Modifications will not affect orders already placed. The current version will always be available on the Website, and its acceptance will be a prior and indispensable step to the purchase of any product.

16. Applicable law and jurisdiction

These Conditions are governed by Spanish law. For the resolution of any dispute arising from them, the parties expressly submit to the Courts and Tribunals of the city of Valencia, waiving any other jurisdiction that may correspond to them, except in those cases where the imperative regulations for consumer and user protection establish a different and non-waivable jurisdiction, in which case the latter shall apply.

SalazonArte has complaint forms available to consumers in accordance with applicable regulations. Likewise, the Customer can address any complaint or claim to info@salazonarte.com, which will be attended to as soon as possible.
